WWE is continuing its efforts to close www.bigvanvader.com for what they believe is use of their trademarked name. WWE contacted the owner and web host of the website and did manage to get the site shut down, however seemingly only temporarily as the website is now back online. The hosting company put the website back online as they couldn’t validate WWE’s claim.
Two days ago WWE contacted the hosting company threatening them with a 5.00pm deadline to take the website offline, otherwise they will be forced to take further legal action against the website.
However, the interesting thing is, is that on 9/16, in talking about the trademark a WWE attorney wrote to the host company, stating that did not file a trademark application for the mark but still has common law rights to the BIG VAN VADER mark.
