Colt Cabana’s CM Punk Lawsuit Thrown Out By Judge, But Second Case Filed

Colt Cabana’s lawsuit against CM Punk, which alleged a breach of contract and unpaid legal fees, was dismissed by Judge Daniel Kubasiak last month via PWInsider. However, since the lawsuit wasn’t done with prejudice, this allows for Cabana to re-file. That’s exactly what he’s done, and now a second lawsuit is going through the Cook County Circuit Court in Illinois.

The latest lawsuit features the same allegations as the first. Namely, that Cabana was told by CM Punk that his legal fees would be covered by him. Cabana originally was seeking $1,000,000 in damages in addition to his $200,000 legal fees.  The new document reveals that Punk had paid all of Cabana’s legal bills until April 2016, when he told Cabana that “you are on your own” in an email.

Cabana is seeking a jury trial, and Punk has to respond by December 28. A case conference is currently set for January 4, 2019.
